This Privacy Policy explains how Cabal Trade Inc. (“Sperm Racing”, “we”, “us”) collects, uses, discloses, and protects personal information through spermracing.com, our social media presence, our SMS programme, and our events. Our address is 329 Bryant St, San Francisco, CA 94107.

This Policy is also the notice at collection required by the California Consumer Privacy Act as amended by the California Privacy Rights Act. It must be linked from every page of the site and from every form that collects personal information, at or before the point of collection.

• To operate, produce, promote, and distribute our events and content.
• To communicate with you, including race announcements and updates you have asked to receive.
• To evaluate and administer participation for people who apply to compete.
• To publish event content, including names, likenesses, results, and, for participants who have expressly consented in a signed Participant Agreement, biomarker statistics.
• To operate and improve the website, measure performance, and secure our systems.
• To comply with law and enforce our agreements.

Health-related information is collected only from individuals who apply to compete and who sign a Participant Agreement authorising its collection, use, and public disclosure as entertainment content. We do not collect health information from ordinary website visitors.

We use sensitive personal information only for the purposes described in the Participant Agreement and for purposes permitted under Civil Code section 1798.121, and we do not use it to infer characteristics about you. Participants may limit our use of sensitive personal information as described in Section 07, subject to the rights already granted in a signed Participant Agreement.

If you provide your telephone number and consent, we send recurring automated marketing and event text messages. Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe and HELP for help. Consent is not a condition of any purchase. Our SMS Terms are available at spermracing.com/sms-terms and are incorporated here.

We do not sell or share telephone numbers collected for SMS with third parties for their own marketing purposes.

We retain personal information only as long as reasonably necessary for the purposes described above or as required by law. Event content and race data may be retained indefinitely because they form part of a published archive. Raw health screening data is retained only as long as necessary to administer the event and is then securely deleted. Specimens are never retained; they are destroyed immediately after processing.

If you are a California resident you may request to:

• Know the categories and specific pieces of personal information we have collected about you, the sources, the purposes, and the categories of recipients.
• Delete personal information we have collected from you, subject to statutory exceptions.
• Correct inaccurate personal information.
• Opt out of the sale or sharing of personal information.
• Limit our use and disclosure of sensitive personal information.
• Not be discriminated or retaliated against for exercising any of these rights.

To make a request, email privacy@spermracing.com or write to us at the address above. We will verify your identity before responding, and we respond within forty-five (45) days, extendable once where permitted. An authorised agent may submit a request with proof of authorisation.

Deleting your information does not require us to recall, edit, or remove event content, race data, or biomarker statistics that has already been published or licensed to third parties, and does not terminate any licence granted in a signed Participant Agreement.

We use cookies and similar technologies to operate the site, remember preferences, and measure performance. You can control cookies through your browser settings. We honour Global Privacy Control signals as a valid opt-out of sale and sharing where transmitted by your browser.

We maintain reasonable security procedures and practices appropriate to the nature of the information we hold. No system is perfectly secure. In the event of a breach of the security of the system involving unencrypted personal information, we will notify affected individuals as required by California Civil Code section 1798.82.

Our services are not directed to children. We do not knowingly collect personal information from anyone under eighteen. If you believe a minor has provided us information, contact us and we will delete it.

We may update this Policy. Material changes will be indicated by the “Last updated” date at the top and, where appropriate, by notice on the site.
